These Terms of Service ("Terms") govern your access to and use of KeywordScout ("Service") operated by KeywordScout("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

Description of service

KeywordScout monitors publicly available content on supported platforms for keywords you configure and sends alerts when potential matches are found. We do not guarantee that every relevant post will be detected, that third-party platforms will remain accessible, or that alerts will be delivered without delay.

Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for ensuring your use complies with applicable laws and the terms of any third-party platforms you monitor.

Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate account and billing information and keep it up to date.
• You are responsible for all activity that occurs under your account.
• You may cancel your account at any time through account settings.

Subscriptions and billing

• Paid plans are billed on a recurring basis through our payment processor unless canceled before the renewal date.
• Free trials may be offered at our discretion and convert to paid subscriptions unless canceled before the trial ends.
• Fees are non-refundable except where required by law or explicitly stated otherwise.
• We may change pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.

Acceptable use

You agree not to:

• Use the Service for unlawful, harassing, or deceptive purposes.
• Scrape, resell, or redistribute Service data except as expressly permitted by these Terms.
• Attempt to interfere with the security, integrity, or availability of the Service.
• Misrepresent your identity or affiliation when contacting leads discovered through the Service.
• Use the Service in a way that violates platform rules or applicable privacy, spam, or telecommunications laws.

Third-party platforms and content

The Service relies on third-party platforms and data providers. We do not control and are not responsible for third-party content, platform availability, API changes, rate limits, or access restrictions. Your use of information obtained through alerts is at your own risk.

Intellectual property

The Service, including software, branding, and documentation, is owned by us or our licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription term.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Termination

We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses risk to the Service or others. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive.

SMS Messaging Program

By providing your phone number and opting in, you agree to receive SMS text messages from KeywordScout Alerts related to keyword match notifications for your monitored groups. Message frequency varies based on your account activity and configured keywords. Message and data rates may apply. You can cancel SMS alerts at any time by texting STOP. For help, text HELP or contact us at support@keywordscout.ai. Carriers are not liable for delayed or undelivered messages.

Changes to terms

We may modify these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
